These Terms and Conditions (“Terms”) are a binding agreement between you and Eden Rose After Dark, operator of Eden Rose / After Dark Magazine at edenroseafterdark.com (the “Site,” “we,” “us”). By creating an account, completing checkout, or otherwise accessing the Site, you agree to these Terms. If you do not agree, do not access or use the Site.
The Site contains sexually explicit material intended solely for adults. By accessing the Site you represent and warrant that:
We may use self-attestation, third-party age or identity verification services, or both, and may require re-verification at any time. Misrepresenting your age is a material breach of these Terms and grounds for immediate termination without refund, and may be reported to relevant authorities where required by law.
Membership is sold as a one-time access pass for the period stated at checkout at the time of your purchase. It is not a recurring subscription: your payment method is not retained for future charges, and access simply ends at the end of the stated period unless you separately choose to renew. Renewing before or after expiration is a separate, deliberate action you take on your account page — we will never automatically re-charge you.
We may email you reminders as your access approaches expiration as a courtesy; these reminders are not a renewal and do not obligate you to act on them.
Payments are processed by our third-party payment processor. Card and other payment-instrument details are entered directly with the payment processor’s own hosted checkout page and are never collected, seen, or stored on our servers. We retain a record of the transaction itself (amount, date, status, and a transaction reference) for accounting and legal-compliance purposes.
All sales are final. Because access to digital content begins immediately upon purchase, we do not offer refunds except where required by law or at our sole discretion. Billing questions, including disputed or unrecognized charges, should first be directed to the payment processor identified on your billing statement, as they are the merchant of record for the transaction.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts are personal to you and may not be shared, sold, transferred, or used by more than one person. Notify us immediately at contact@edenroseafterdark.com if you suspect unauthorized use of your account.
You may change your password and username, and request deletion of your account, at any time from your account page. Deleting your account is immediate and permanent for login purposes; see our Privacy Policy for what limited records are retained afterward and why.
All photographs, video, magazine issues, and other material made available through the Site are owned by or licensed to Eden Rose After Dark and protected by copyright and other intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to view that content for your own personal, non-commercial use, for as long as your membership is active.
You may not, and may not allow or assist anyone else to:
Content delivered to your account is individually and visibly watermarked with a mark tied to your membership, specifically to deter and trace unauthorized redistribution. You acknowledge this watermarking occurs and agree it may be used as evidence of a Terms violation. Violating this section is grounds for immediate account termination without refund and may expose you to civil liability.
The Site’s messaging feature is provided for direct communication between members and Eden Rose staff. You agree not to use it to send unlawful, harassing, threatening, or abusive content, or to solicit information from staff that could be used to circumvent these Terms.
In addition to the restrictions above, you agree not to: violate any applicable law; infringe any third party’s rights; interfere with or disrupt the Site’s operation or security; attempt to gain unauthorized access to any account, system, or protected content; or use the Site in any way not expressly permitted by these Terms.
We may suspend or terminate your account, without refund, at any time if we reasonably believe you have violated these Terms, misrepresented your age or identity, engaged in fraudulent payment activity, or for other legal or safety reasons. You may delete your own account at any time as described in Section 5.
The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Eden Rose After Dark and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Site will not exceed the amount you paid us in the six months preceding the claim.
You agree to indemnify and hold harmless Eden Rose After Dark from any claim, liability, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continuing to use the Site after an update constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
